Meaning of last residence

(Querist) 20 March 2011 This query is : Resolved
Sir,
I have filled a divorce suit against my wife. My question is that I some times stayed in my brother-in-law's house to see my wife and newborn child. Does it mean that place of last residence is my brother-in-law's house?
Devajyoti Barman (Expert) 20 March 2011
Here residence means place of ordinary residence. The place of brother in law was used for staying for some days,it was not a place where you ordinarily resided.
R.Ramachandran (Expert) 20 March 2011
Place of last residence means the residence where you and your last resided as husband and wife. Instead of meeting at your brother-in-law's house, you might have met her at hospital, hotel, temple etc. They are not place of residence.

The last cohabitation you both resided together, ordinarily where you both have enjoyed the status of H-W and as family; and the essence of the residence is that it should be permanent in nature, duration is not the thing say if you belong to X place and due to some reason you both have come to Y place and from there itself you both have decided to separate for some reasons, then X place is the last cohabited residence and not Y.

In matrimonial cases, place where last resided deals with the place where both jointly resided as man and wife

I agree with the both views of Mr Gulshan and Mr Ramchandran.
