Divorce

RESPECTED EXPERTS,

My wife left me in 2002,now living in her parental house.Since then we have no relation as wife and husband.On 2007 he claimed maintenance for herself and child(one girl child) and court allow the maintenance petition and am paying them maintenance since then as per court direction.We are Hindu by religion.

AND in 2010 I filed Divorce Petition from her which I lost and did not get the divorce.

As I am already 46 years now, in depression as neither she accept divorce nor want to come back to me.

MY QUERIES:-
1.-What is best possible way out for me from this trouble.??

2-I am thinking for another Divorce Petition in place where I am serving(I am serving in a State other then our native state ).Is my Second Divorce Petition will be maintainable in Court.

3-What could be the legal effect of my concealing the fact that 'i have lost one Divorce Case earlier' in my intent Divorce Petition.

for what reason your divorce petition dismissed?
Even if you filed another divorce petition your wife will appear and will produce the order of the earlier divorce petition.

did u challenge that order in first appeal before the hon'ble high court. u can file a case of restitution of conjugal rights before the family court. u cannot file second divorce petition untill and unless for some reason it is important to know whether u have challenge the order of family court in the hon'ble high court. if u r from mumbai call me on my mobile no. 9892115025 for any help

The best thing would be to reconcile if both of you are still compatible. Once the earlier got dismissed you can file a second suit for divorce. Even if you conceal that would not make any difference as once the wife appears the secret would be revealed.
