Summon issued by Session Court not accepted

(Querist) 16 February 2011 This query is : Resolved 

Myself is Deepak Kapoor resident of Ludhiana (Punjab). My father is running a proprietorship firm in the same city since last 7years. In 2007 a case had been filed by a worker in labour court for non payment of his wages, in fact there was no dues pending and he had no evidence that our firm owed to him. Once my father went for appear in the hearing but there was nobody, so he came back, after that 2-3 times notice issued by labour court but we didn't accept because name of firm which was mention on the notice Steel Maker instead of Style Maker.

Now 2 days ago, a summon issued by Session Court in the name of M/s Steel Maker (wrong name) and also wrong house no. 7050 instead of 7052 rejected by owner of house no 7050 and he told the same to me.

Please advice me on this matter.

No need to accept the summons. It would be helpful if you ask the postman to return the article with the note that address does not match.

You can reject or collect the summons and face the case. At the time of hearing you can mention the mistakes.

it will be good ground for setting aside the judgment, if the case is decided against you ex-parte.
