How to remove Default name from CIBIL

HDFC bank has made my account NPA illegally,we file a case in DRT and got stay in April 2010,since than case is going against HDFC bank,HDFC has put my name in default list in CIBIL,can bank put our name in default list unless judgement is not passed or even during pendency of case,they have got power to put my name in default list in CIBIL.?
What is remedy or which court or forum we should move for remedy to remove name from default list.

Bank has got no such right untill the case is decided. You go to DRT and get remedy therefrom.

I differ. As long as your account is not closed with the bank, they will show a defaulter only.

If your name is put inthe default list of CIBIL after obtaining stay order, you may bring this fact before the Court issued the stay order and get its direction.

You may approach ombudsman with a complaint. Unless you are a defaulter, it is unlikely that you would be termed as defaulter. Please ask the bank why they have listed under the category defaulter.
