Can I prove my case???

Querist : Anonymous (Querist) 29 December 2010 This query is : Resolved 
I was wrongly prosecuted by some one,from which I was acquitted getting benefit of doubt.

I have filed a suit for malicious prosecution seeking damages of Rs. 2.5 lakhs.

The case is on argument stage.

I have not filed any documents to prove that how I have suffered this loss of Rs.2.5 lakhs.I have also not even filed any Income tax documents to prove that I have actually suffered this loss.Though it is a truth that I have actually suffered that loss.


My notice to the opponent was not replied but after that he is pursuing the suit with great efforts.



What are my chances of winning this case?


Is there some thing which I can do yet to win this case??

The damage cannot be assessed thru., documents. How come you will get the documents for mental harrashment.

I agree with Rajeev,,,

in addition to that my friend, if you were acquitted of the charges in that criminal case while extending you the benefit of doubt, then you have dim chances of succeeding your case....especially if the criminal court has not given the finding in judgment that whole of your prosecution was motivated, absurd and abuse of process of law...Mere an acquittal on the basis of benefit of doubt is not helpful in succeeding the case of malicious prosecution....
however consult your advocate and if you have some more evidence then apply for additional evidence....

If you are claim damages for the loss of reputation or mental agony then you need not describe any calculation or supporting document. You need to file such documents only when you need to get physical loss from iinjury.
