Unnecessary harassment

Sir,

I was Secretary of CHS in past and one lady in our society used to harass us with water problems, maintainence charges problem. She compalined with Registrar of Society, filed a case against society which she eventually lost as we the members of society did nothing to harass her. Now with no option left, she has filed a false criminal case against 7 members of the society for further harassment. Kindly advice.

What facts should I mention?

Insult in public, criminal nature and many other small petty bailable offences which are totally false.

When a complaint is filed with the police, the authorities in police station would call both the parties and make enquiries to see if the complaint made is of any substance or baseless.

When you are called to attend the police station, you may explain in detail what has happened. The police if convinced would close the file.

However, if the police are influenced to file FIR, then you need to challenge the FIR in the High Court under Section 482 of Cr.P.C.

You can resort to Sec.482 Cr.P.C. and seek quashing of the criminal case.
