Parties are in different state .Whether they can file plaint together in one state with out leave from Court?

Yes but leave of the court should be taken.

Yes. In a civil suit, the place of residence of the plaintiff(s) is immaterial. If the court is having territorial jurisdiction to try the suit, any number of plaintiffs from any number of places can institute a suit by filing their plaint without leave from the Court.
