Brother married in May 2009, his wife left the house after two months and after many efforts she was again residing seperately from my parents. In March 2010 she again left her independent house due to illegal relation with her ex.boy friend.
I want to know following _

1. My brother filed R.C.R. in mid of April 2009, & when semmounus was sent to her then she & her father refuse to take this and they filed two cases in 125 & DV etc.
i] May i know is it any benefit to my brother if he filed RCR first.

ii] Even publication till now she is attend any date of RCR nor accepting RCR.

iii] she is residing with her ex.boy friend since May 2009 can she file 498a or not .

iv ] She and her blackmailer father demanding huge money for settlement what we do in such case.

v ] can my brother file divorce now

vi] what another steps will be taken to rid such corrupt peoples.

kindly advise accordingly

Your brother can file a divorce case now, showing the reason of adultery.

She can file 498a case if the said offense is occurred when they were living together.

Take the help of an advocate with your physical papers.

1. Yes if the suit is decreed.
2.Ask the court to fix ex parte hearng of the suiit.
3.Yes, no difference in lodging the complaint.
4.Do not budge under any type of pressure.
5.No unless new cause of action arises.
6.Fight tooth and nail till last.
