How can you prove your case that your husband only hack your mails? Cos if both of you browsing from a same system..

Dear Mr. Tom,
He done from cyber cafe and we not leaving together last many days. And I was using my emails from last 2 months from my office and home and he done now and we not use same system. yes some time i was using his laptop but its long time back. he done from cyber cafe.
Kindly tell now what is the option?

For hawking of your email, you want to initiate case against your husband. Then what will be your relationship.
I think it is not a real situation. It seems you have raised this for academic sake.

You must have valid evidence to prove that he hacked. Otherwise no criminal case can be filed.

Yes. you can file case against your husband.The hacker may be any family member, partner or spouse of the victim. Penalties are same for all the email hackers even if he or she has any close relationship with the victim. Section 66 of IT Act -Hacking ( punishment upto 3 yrs/fine of 2 lakhs) but one aspect you must think wisely that it could adversely effect your married life....
