sale agreement validation regarding

dear sir,
i am amarnath pv.i have one doubt regarding sale of land agreement. details as follows

i had made an agreement dated july 2007 for sale of my land 2 acres. we had initiaally written an agreement on 100 rs bond paper for sale of land costinging 6 lacs. now almost three years has been completed.still the openent didnt pay total amount but given only rs 1 lac as advance .almost 3.5 years has been completed.now i am thinking of selling the land to another person.does the agreement will validate in the court of law. can i sell the land to other persons?

Dear Amarnath,

Usually all sale agreements will have a fixed time to complete the sale. If the other party has not taken steps to purchase the land from you within a reasonable time or within the fixed time limit as per the agreement, then you can sell the land to anyone you wish. But it is safe that you first issue a notice to the other party that you are canceling the agreement since it has been nearly 3.5 years the other party has not paid the full amount.

The terms of agreement has not mentioned in your query.If there is clause of due date and cancellation of agreement for non payment of balance. The purchaser failed to pay the balance on or before the due date. The agreement stands cancelled. Issue a legal notice the purchaser.
