Querist : Anonymous (Querist) 03 October 2010 This query is : Resolved 
We have filed FIR against our employee. Address is found, but the Accused employee is absconding. What are the alternative before us now. I am thinking of publishing a public notice with photograph of the Accused in English & regional newspaper stating that "This person was working with us and now committed from of XYZ amounts in our company. We have filed an FIR against him and he now is absconding. Anyone knowing his whereabouts may please contact on XYZ numbers."
The other option is can we move an application before the jurisdictional Court for a proclamation.

If the FIR is registered then you will have nothing to do. The investigating agency would do the needful. If not, then apply before the Magistrate for necessary action. The petition for declaring the accused as ;proclaimed offender' arises only when the trial commences.

I agree with Mr. Barman. It is the duty of the authorities concerned to proceed with the enquiry and file charge sheet. The investigating authorities will take appropriate steps in this and if they do not proceed with it then you can approach the District Magistrate or the High Court concerned for a direction.
