Labour license

If a contractor started the Civil construction work without getting Form-V from employer. and after three months employer give Form-V to contractor of currrent date. Can contractor apply for labour license. Is any penlty impose.

Before commencing the Civil construction labour license should be obtained, however, some time it is purely desecration of the Authority.

It is always better to obtain license before commenting the work. however, I can be asked afterward during the continuance of work. But this would not legalize the offence already committed. Employer and contractor both are liable for penalty under Contract Labour (Regulation and Ablution) Act

HOW Much penlty contractor & employer will be bear? can contractor now apply for labour license.

A person who is guilty of contravention of provision of Act is liable to be punished with with an imprisonment, which may extent to three month or a fine of Rs. 1000/- or both. in case, the person contravening is a company, then the company and as well the persons responsible to conduct business of company are liable for the above offences. Normally these offence are settled in lok adalat and court imposes fine only.
