Cancellation of Sale Deed

Hi,

I've recently made a sale agreement to sale my house. But i don't want to sale it now due to my family problem. Is it possible to cancel the sale agreement and return the money which i got as advance.

Unless the other party also agrees for the cancellation you will not be able to cancel the Agreement to Sell entered into by you, especially if the other party is ready and willing to perform its part of the contract.

If the agreement contains any cancellation clause then only it be cancelled subject to that clause.

even if the agreement does not contain any cancellation clause, the cancellation of the said agreement does not invalidate.

If both parties agree to cancel sale agreement, they can cancel it.

Both parties willing, then the agreement can be cancelled. Otherwise it will be difficult to cancel the agreement except under extraneous circumstances.

My view is also in favor of Mr. Ramchandran.But in the agreement if there is a condition regarding termination of contract on part of vendor exists he can terminate it only default clause does not help you.

I agree with mr.ramchandran. Even if its contains any cancellation colum mean you may try by issuing a legal notice. Consult your advocate..
