Motor Vehicle Accident Claim

In a motor vehicle accident if the driver of a vehicle1 dies in a hit and run case by another vehicle2 which is declared untraced. The driver of vehicle1 who died does not have a driving licence. In this case is the owner of the vehicle1 liable to pay compensation to the family of driver. The driver of vehicle1 has taken the vehicle from owner for some purpose but used the vehicle for totally different purpose and ended up in the accident.

Owner in my opinion is not liable in the instant case.

I do feel owner is not liable,since he had not availed the service of the driver .
