INDIAN RAILWAYS ACT 1890

DEAR FRIENDS, i want to know still Indian Railways Act, 1890 is in force and Notice under Section 78B is (Statutory Notice ) mandatory .Because i can not find out the said Act even in INDIA CODE. Still in force means , can u help me to get that act through online. Because i have to file the case against Railways on behalf of Insurance Company as Subrogagee . my e mail ID: advocatemanoharan@gmail.com . Thanks in advance.

I, the undersigned A, etc. hereby give you notice under section 78B of the Indian Railways Act, 1890 as amended by Act 39 of 1961 upon the Railway to pay to me a sum of Rs . ....................... within ....................... days from the date of receipt of this notice as compensation assessed on account of short delivery in the above consignment. Please note that a suit will be filed against the Union of India, owning and administering the said railway for recovery of the said sum with interest and costs after service of notice under section 80, Code of Civil Procedure.
