Registaration of Property

Querist : Anonymous (Querist) 02 August 2010 This query is : Resolved
Dear All,

I would like to Know that if some properties were purchased in past say about 20 years back on the basis of agreement and no sale deed or registration has been done, then is it possible to register or make a sale deed now with the same jantri value of the past?

What would be the cost if it is to be registered at todays Jantri Value?

Can any one give todays rate that is been charged on the property?

What are the other way to safeguard the Title of the property for future transactions?

Please reply as soon as possible.

Thanks & Regards

The cost of the consideration shall be treated as of latest value of the area fixed by concerned DM. The rates vary from area to area in the same city. Even the value differs front and behind side of the same locality. So go to deed-writer or registrar office and enquire about the latest rates and get the sale-deed registered.

There is no other way in the given facts to safeguard your interest over the property. The agreement executed 20 years ago has no value before the eyes of law so make hurry and without wasting much time get the job done otherwise you can lose that property.

Raj,

I do not know on what basis you have "on your own concluded that the author of this thread is going to lose the property (just because it is not registered).

Pleae refrain from indulging into such flimsy anxiety causing otherwise baseless statements.

Very emphatically it could be concluded that he is having unchallenged possession for more than 19 years.

There is no reason or rhyme to say that an unregistered agreement executed 20 years ago does not have "ANY" evidentiary value - you for the reasons best known to you have forgotton that the unchallenged possession is with the author.

Last but not least let's presume a collusive suit and this gentleman gets a interim order which gets confirmed does not tantamount to right in rem as well without registration.

ONCE AGAIN JUST FOR THE SAKE OF EARNING QUICK POINTS WE SHOULD NOT PLAY THE SENTIMENTAL CARD/ANXIETY CAUSING SYNDOROME. I HOPE THIS LAST TIME THE POINT IS WELL TAKEN FOR ONCE AND ALL.

BEST REGARDS

DAKSH
