Case Law On Book.

(Querist) 28 July 2010 This query is : Resolved 
If A book is written by a professional degree holder of any stream & the book says the opposite of the statue (ACT) on which statue the book is written than who is liable whether the author or no one any case laws of apex court than pls forward.

EG:( A statue Income Tax Act, 1961 says section 80 C is applicable to all the persons & the book written by a professional degree holder who do pratice or works in a MNC has said in the book that has been written by him it is only applicable to HUF) than the opposite perons reading the book will only consider the deduction available is to HUF only & files the tax returns.

So if the book written by the professional degree holder makes any mistake while writing in the book than he is liable for an any offence or not also he is governed by which act with the section also any case laws which punish the professional degree holder who has written the book & created any mistake in writing or interpretating the law.

exprtessing a wrong legal opinion is not an offence defined under any law in india. it should be ignored or it should be brought to the notice of the authorfor being corrected.

Book is pesonal opinion it may be against but for which an auther cannot be penalised.
