Sir My grandfather got neelami property measuring 14 kattha in bihar in the year 1935. We have the land certificate on stamp paper by court. The land is in our possession. The mutation has not been done. Am I still the owner of the property. Can the opposite party get the land certificate nullified. If the karamchari refuses to do mutation of property then what is the procedure.

Check the revenue records whether your grand father's name is mutated or not at that time. Check Encumbrance certificates for 30 years. If continuously they show clean record you'd be saved. you will get clear title.Certified Mutated properties standing in the name of your grand father you get certified copies and show it to Karamchari and get him convinced that you have rights on the land.

If you have land certificate of neelami property you can mutate the property in your grandfather name or their legal heir name. Karmachari has no discretion. If the document is genuine he cannot refuse.
