what are the remedy to acquited from Section 302 of IPC

(Querist) 17 November 2009 This query is : Resolved
UNDER WHAT CIRCUMSTANCES IF A PERSON IS CHARED UNDER SECTION 302 OF IPC CAN BE ACQUITED
Kiran Kumar (Expert) 17 November 2009
Mr. Patil it is totally a vague query.

all depends upon the facts and circumstances of the case, the entire evidence has to be appreciated before making any decision.

the offence has to be proved beyond reasonable doubt and certainly if there are two opinions in a case then the one which favours the accused must be upheld.

adv. rajeev ( rajoo ) (Expert) 17 November 2009
it depends on the evidence of the case.

You tell the circumstances prevailing in your case and we can tell whether this is fit case of acquittal or not.
bhupender sharma (Expert) 23 November 2009
unless and until u did not share your facts it would be premature to come to the conclusion.
