Pending payment

I resigned on 7 jan and my notice period is of 90 days
i serve up to 16 march and my balance PL & EL was 30 days
I have also claim of 15600 which is duly approved but unpaid

now my Hr is not giving the NOC or balance salary

Generically speaking: FnF statement encashed leave that can be encashed , earned wages, reimbursements/OT/Bonus/incentives etc etc and adjustment of notice pay and final amount payable…………..
Did you recieve FnF statement, acknowledgment and acceptance of notice of resignation, final resignation, acknowledgment of handover of charge/assets etc etc…………..

What is this NOC and why it is required or demanded from you or by you?
Is employer or its attorney’s in HR/Legal/admin/personnel etc etc declining to accept your notice/final resignation?

While posting such queries employee should post basic information!
What is this establishment; Commercial, Industrial?
What is its nature of business say; IT, ITeS?
How many persons are employed in it?
What is your designation and nature of duties?
How many persons report to you?
Do you have any power to sanction leave/increment/appoint/terminate/appraise etc etc ?
You are in which state? Since how many months you are working?
Do standing orders (model/certified) apply to establishment and your designation?
What is notice period as per appointment letter/offer letter and what was notice period tendered by
you?
Was ever any stinker, memo, show cause notice on any misconduct issued to you?
Are you a member of employee’s/trade unions?
Has the establishment issued/supplied, salary slips of all months, PF number and a/c slips of all
years, ESIC card,?

Have you amicably got approval / settled with the HR / employer regarding the arrangement that you are going to purchase part of notice period by surrendering your leaves / payments? If not, employer may not allow you to get benefit for a fault from your side.

You can not decide terms of leaving yourself without due approval from employer.

The notice period of 90days may not necessarily be applicable in your case even if it is inserted in appointment letter by employer or attorney's of employer.
