if a student seeks admission in a course in which he opted for both open as well aspayment category but he is being given seat under payment category ,he stands second in the payment category, he pays the fees after taking an educational loan from a bank then he comes to know from sources that two students have left the course and two vacancies are created in the open merit category he approaches the authority for considering him in the open merit category and refund of the amount paid but the authorities say that the admission process is closed and now you cannot claim any refund

U have selected and admitted to the course on payment category. Ur admission process is complete. So u cannot claim the refund of already paid fees. Considering and non considering his request is internal matter of the college adminatration.

Once a stand accepted, cannot be changed on the basis of later developments. Had you waited the vacacies and wouldn't had opted to take admission in fees category then your claim was genuine against such vacancies arised later but in the given circumstances you have no legal claim.

You can not claim to refund the already paid fees because you have selected and admitted to the course on payment category.

Even these two vacancies created by leaving the course by these students also be filled by taking payments by the authority as it is their internal matter, so you cannot insist for refund the money by thinking so.

dear friend pls check whether the concerned college and concerned university has any rules for the refund of fees.
if any rule favourable to you is not there in that circumstance you can not compell te authorities to act according to your wish.
the seats were vacated after your admission, so there will be no violation by authorities unless the rules provide to the contrary.
