Application u/s 411 cr.pc dismissed by sdm, revision is maintainable in session court?

(Querist) 19 October 2011 This query is : Resolved
hello friends,
executive magistrate SDM issued a notice to us u/s 145(1) crpc, and after appearing in this case, we filed written statement along with an application u/s 411 crpc that SDM is a party against us in a criminal petition pending in punjab and haryana high court chandigarh, and he should not hear this case u/s 145(1) being a party in high court against us, which is based upon the same facts directly related to this case u/s 145 crpc and any decision taken by him should be biased and one sided and against the merits of the case as he is litigent against us in a case based upon same facts of case u/s 145 crpc, but he dismissed the application on the ground that it is baseless, now we filed a revision against said order of dismissal of sdm of our application u/s 411 crpc, now opposite lawyer is saying that this order was interlocutory and revision against this is not maintainable, so plz give me judgements/authorities that revision against this order of dismissing application u/s 411 crpc is maintainable

Revision against interlocutory order of that nature is very much maintainable either before the sessions court or before the high court.
