Cancellation of poa

Querist : Anonymous (Querist) 15 July 2023 This query is : Resolved
Respected Experts,
I executed a Registered Power of Attorney (POA) in favor of my brother in 2005, granting him the authority to manage and sell the specified land. However, I now wish to cancel the POA and would appreciate guidance on the procedure to do so.
1. what steps need to be taken to initiate the process? and
2. I would also like to know if Is it possible for the civil court to cancel the POA?

Notify the POA holder by registered post, that the POA is withdrawn with immediate effect, and he will be liable for action if he misuses it without authority.

Then, register a Cancellation of POA at the Sub Registrar Office, for cancellation of POA.

You can also publish the matter in the local newspaper if you think the POA holder will use the POA against your interest.

It seems these are the possible options.

Yes. You inform the agent that you are cancelling the POA and register the deed of cancellation of POA in the sub registrar office concerned.

Agree with above experts.

You issue a legal notice to the power agent communicating your decision to terminate the power of attorney deed given in his favor and publish the same as a public notice in the local newspaper, after that you can approach the registrar office with a deed to cancel the registered POA deed.
