Khulanama

Querist : Anonymous (Querist) 26 July 2011 This query is : Resolved
Respected experts,
I am muslim got married to a christian girl, through muslim marriage act in a different state, she converted by accepting islam and got an affidavite done. we now got seperated through a khulanama, intiated by her, and got it notarized in the current residing state. the agreed khula was made on the stamp paper. ( as she was uncomfortable to come down to a qazi's office )
My question is, Is the Khulanama valid?, as i am planning to immigrate to dubai and get married there to an indian girl , who is working there.
Your response will be highly appreciated.

you have to register your marriage in special marriage Act

YES THE KULANAM IS VALID.

No. This Khula is invalid as according to Mohammadan Law, your wife might have gone to the office of Quazi and return of Mehar might have also taken place. Still you both are husband and wife.

The Khula is valid.
