Debt recovery

Hi,

I am a businessman from Kolkata. I am into advertising branding and communications business. Last year I had done a business with another similar advertising business agency from Mumbai. This business is a private limited company. They issued us PO against which we executed their jobs in Patna & Kolkata and sent them all documents for payment. After initial payments, they have stopped paying us our dues and not responding to our communications in any form. Our current dues are almost 5 lacs. How can my dues be realised? I am willing to pay 10% of my payment realised. Please advise.

Show the agreement, PO, tax invoice and other related documents to a local prudent lawyer (in Kolkata) for issuance of legal notice followed by suit for recovery in the jurisdictional Court.

You have not stated, whether you entered in to any agreement with the firm or not before taking up their job and for what period to be covered for ad? Please clarify.

Moreover, your dues cannot be treated as debt, as you have classified, as you have not advanced any loan to your client. That can be said to be the outstanding part of fee, commission, or remuneration for the service rendered by you.

You can file recovery suit against your client for recovery of your dues.
