Expedite dv case .

What is the procedure to expedite DV case (4 yrs old)in trial court ? I have already given an application in lower court but long dates are being given .Should I be filing a writ in high court to expedite ?
Experts please can u guide me on this ?thank u .

Courts are over burdened with huge backlog of cases. There may be cases older than urs which are lined up before ur case. If u are having any special grounds to justify ur request for expeditious hearing u may move an application before the court. I do not think any useful purpose will be served by filing a WP in the HC. There is no guarantee that the WP will be heard immediately.

You can file the Writ Petition in the court citing the objective of the D.V Act and your financial conditions. The High Courts in most of the cases fixes up the period by which the case has to be disposed of. But again going to high court is an expensive issue. You can take the help from District Legal Service Authorities for free legal aid. No harm in approaching High Court for genuine cause.

Sir ,I am aware that the trail court is burdened ,I had moved an application sometime back before the trail court so it gave few short dates but then again court gave me the same reason that it's overburdened .Now husband is going abroad for long duration ,so I thought I could approach the high court as the trail court it transferred when evidence of respondent has closed .I have an apprehension that the new court will take more time .
Experts please let me know if there is any way out .Thank u .
