Sell undivided property

My father have ancestral undivided 40000 square feet property . Total 5 name mentioned on property (including my father).
Can my father sell his share in property as per Sunni Muslim law without partition?

Claim on property as one of legal heir

My Father was residing in Mumbai on Plot of ancestral property including 5 other plots.
After the death of my great grandfather my grandfather's name is entered as died unmarried.But, the facts is he was married n missing for many years. therefore, we dont have his death certificate.
How, Other legal heirs, my cousins have sold out one of the Plot out of six and developer constructed a building.
My father has nothing to show in writing that he was residing on the said Plot. My query is..I want to enter my own name on property card. For this my father's name must be there..which is not on property card.I am in process to get copy of Conveyance Deed under RTI Act.
1. Can I file Civil Suit against cousins, developer, Society?
2. how will I know on which basis my cousins declared that our grandfather died unmarried..?
3. What will be the other remedies?

Legal effect of mediation settlement

Dear Sir,

A suit was settled in the Mediation and Suit was dismissed as withdrawn in view of the mediation settlement.

Now Parties are breaching the terms of the Mediation settlement....

What is legal effect and remedy to other party.

Is revoke of gift deed possible by donor after donee death

My grand mother gifted 5 flats to my father through registered instrument in June 2012 without notice to my dad's brother and sister. On feb 28 2015 un fortunately my dad (donee) expired. Now I got the information from my relatives that my dad's brother and sister along with my grand mother (donor) trying to revoke gift deed on the ground that my dad did not accepted gift in his life time. Unfortunately we have no proof of possession. Even electricity bill was not muted in name of my father. Please help me with suggestions and what remidies I should take.

Need to apply in appeal court, within 30 days or next court date?

Hi,

I am the defendant and this is a civil matter. I am not in agreement with the recent court order. Next date is in Sep month. I am talking with my lawyer to go for appeal court or not, but wanted to know if there is any time span before which i need to raise it to appeal court like 30 days or before next hearing date in the current court?

Competition Act, 2002 - Non - Compete Clause

Dear All,

1. Whether Insertion of Non Compete in the Agreement for not can be possible by inserting a specific time Limit?

2. If yes then up to what Limit we can enforce the Non-Compete clause?

3. If No then what should be the recourse for the Party Sufferring the Loss? (If the Loss under Non- Compete Clause is not covered in Agreement)

4. Is there any Judgement of SC or HC regarding - "Non- Compete Clause is illegal" in Agreement?
