Notarized gpa powers

What will be the status of Agreement of sale cum GPA (with possession) in the year 1997. When the Agreement of sale cum GPA.is only attested by notary. and revaildated in the year 2008.Are this agreement of sales cum G.P.A. is valid or not. AND CAN IT USED FOR NEW REGISTRY

Agricultral gpa transfers

Can an agriculturist execute a GPA in favour of a Non Agriculturist, by giving the powers to alienate his agricultural land to an agriculturist. Please clarify

Kartha selling property - minor status of daughter

Kartha of a family which has some ancestral property had 2 children - a Minor daughter(17 years)and a major son (20 years). To meet the expenses of marriage of the daughter - Jewellery, cloth, dowry and marriage expenses - with no money in hand, kartha sold some ancestral property, which is co-signed by the major son. The sale proceeds was exclusively used to meet the expenses of her marriage. The land has changed several hands from then on.

After 22 years of this sale transaction,now the daughter gives notice to the existing land holder stating her interests as coparcener in the stated property and stating that as Kartha of joint family her father's act of selling the land is illegal and she is demanding partition of the property.

My query is:
a. When Kartha has acted in the interest and for the benefit of the minor daughter of the family to meet legitimate expenses, does this not amount to giving the daughter her portion of the property sold in question.
b. Whether Kartha has no powers to act on behalf of minors in the joint family when such act is done for the benefit of the minor.

Looking after parents

I am a senior citizen of 70 years of age and divorced. After divorce, as per the court order, I was giving child maintenance to my wife till my son completed his education and started earning. I did not remarry and staying alone after divorce. Because of my age I am not keeping good health and hence can not look after myself properly. I am financially weak as well and hence the quality of my life is compromised. Is there any law with the help of which I can make my son look after me and support me financially as well. Please advise !

Overnight stay of guest at apartment

Can anybody tell me whether apartment association have the rights to decide who should stay in my apartment overnight? I want to keep my carpenters overnight stay for 20 days to complete my house interior work. Whether assoc. have any laws to prevent owners rights regarding rights of admission inside the flats?

Propar method to show respondent

I am drafting a PIL for the rights of Innovator and Researcher of India.
The respondent of my case is
Department of Science & Technology
Now give me clarification which method is proper between following two ways to show as respondent in my PIL

Method No 1

Secretary, Department of Science & Technology,
Technology Bhavan, New Mehrauli Road,
New Delhi – 110016

Method No 2.

Union of India,
Through Secretary, Department of Science & Technology,
Technology Bhavan, New Mehrauli Road,
New Delhi – 110016

There are some questions in my mind,
1) What is the difference between that above two methods to show as respondent?
2) Which method is proper and why?
3) Give me some more general information about this issue please.

Lien for a time barred loan

Hello,

I need expert opinion regarding time barred claim.

We took an educational loan in 2007. Till 2009, we paid all the EMIs regularly. Later the bank misplaced/mishandled the loan details and refused to accept the EMI. By mistake they saved it as a Housing Loan instead of Educational Loan. Even after repeatedly asking for the EMI details, they didn't give us any details of outstanding loan amount. Therefore we stopped paying installments. There was no notice sent by the bank till 3 years.

After 3 years, in 2013, they called my father and asked for the payment. My father knew about the Time Barred limitation and hence he didn't give any acknowledgement to the bank. My father asked them to send a legal notice but the bank manger didn't send us any notice (as he knows that they can't get the claim legally after 3 years).

One month back, some amount was debited to the account for Income Tax rebate. The Bank is not allowing us to take the money from the account anymore saying that it is a "Freeze Account" in lien of the unpaid educational loan. The amount is shown as a ledger transaction not available for withdrawal. The available balance is shown as negative amount.

Is it legal for the bank to lien a account for a Time Barred loan? What can we do to withdraw the money from this account? Please advice us regarding this.
