Parking issue

If the car parking owner covers/closes the common duct area for his own purposes without society's permission, can we file a complaint against that flat owner? The first thing. Is it valid to allot car parking under the common duct area? The town planning office has provided a parking-sanctioned plan That parking is not shown on the plan.

Appeal in the bombay high court

I lost my case in the Pune Civil Court and I have appealed the judgement in the Bombay High Court. I delayed by
196 days, so I need to get a hearing for condonation of delay. I flied my appeal in April 2023 and my high court
lawyer still has not got a date for a hearing. How long does it take to get a hearing?

Share certificate




Our building is preparing to go for redevelopment. Conveyance order recieved from Registrar. Stamp duty paid and registration is due this week as all procedures have been adhered to.

A separate exercise being done by Society who has asked all members to show Share Certificates physically to ascertain how many flats are on mortgage. The certificates will be returned immediately after checking by committee members. Few members have mentioned that all documents including share certificate are in the custody of bank. Is it possible that we get the share certificate attested by bank manager with a remark that the original in their custody. Alternatively, may be a letter from the bank should suffice mentioning that the same is in their custody against mortgage.

Please clarify.

House ownership change in registry after fathers death,

Hello,

I live in my own house with my Mother and sister. The house registry is in my Fathers name. Father died in yr 2014
My father did the registered will which says the current house will belong to me and and my mother. Father built house with own money

Now we want to construct the 1st floor. The architect told us to get the property registered in my name and my mothers name since it is required for naksha approval in Ghaziabad development authority (GDA) for 1st floor construction

I asked few lawyers and they say there is no concept of Updating new names(my and mothers ) in house registry once the father dies.


1) what should I do ?

2) I heard there is a concept of mutation of house property ? what does it mean ? Do we need to get mutation of our house ?

3) is mutation to be done in GDA or Nagar nigam ?

3) what is the process of mutation ? Do I need to hire an agent or hire a lawyer for mutation

4) ANy fee required for mutation ?

Using office at father's business place.

Hello experts,

I am a young lawyer with one year of experience in advocacy. My father, a businessman, operates a small factory, and I have recently opened my law office on the same premises. I am seeking guidance on whether I need to register my office formally or if a rent agreement with my father is necessary, or if I can use the office without any formal documentation.

Additionally, I am curious about the rights regarding the privacy of my office. Can any department officer enter my office without my permission and inspect my clients' files?

I appreciate your expert advice on these matters.

any contract OR agreement, if signed by First Party and not signed by Second party and with no witnesses....

Whether that contract OR agreement is valid or complete..

Reply to case

TP was filed in supreme court and notice issued and opposite party filed reply in which they have prayed to dismiss the case. My query is on next date do I have to file rejoinder or case will be decided or dismissed.

Regarding private case filing against inspector

The Inspector has filed a false case on 08.12.2021.& remanded.

I have lodged a complaint against the Inspector.
to the state human rights commission on 15.03.2022. They have allotted only diary No.

After a long struggle with state human rights commission, chennai 600 028, I have received the case no under the RTI Act 2005.

Till now, they have not sent summons to appear before the state human rights commission.

The answer they given under the RTI Act is the reports called from Tamil Nadu, Tiruvallur District, SP, P Cephas Kalyan, who didn't give the reports for long time.

SP Cephas Kalyan, Tiruvallur District, does not want his subordinate Inspector c Martin premraj to be punished.

I have submitted an RTI application to Court Master, Public Information officer, State Human rights commission, seeking information Action taken report about the atrocities of Tiruvallur District, SP, P Cephas Kalyan.

Also sought the photo stat copy of letter sent by
SHRC seeking the reports called letter.

Is there any time limit for filing a private in the local magistrate court.

Can we ask the transfer of Petition from SHRC to any other court

Leakage from my flat to the one residing below

I need help, I have a flat in Mumbai - Mahim West . Few year back I got the bathroom work done and few month post which the leakage occured in the flat residing below me. The secretary of the society and the committee members along with the flat owner residing below me visited my flat and inspcted the leakage. The issue was fixed up by my as per the instructions given to my by the flat owner residing below witnessing the secretary. However the leakage still prevails and the society along with the secretary forcing me to again relook at the other wet patches from where the leakage is occuring. They also did the therman scanning from the flat residing below, as i denied the therman scanning from my place . Thy have imposed that thermal scanning charges onto my bill, which i am ready to pay. Now the secretary has made a complaint to the registrar of society stating I am ignoring the issue. They have not highlighted my side of the repair work done as per their instructions received earlier. I have already spent an amount of Rs. 62,000 for the repair work and the society has imposed additional therman scanning charges to me of Rs. 11,000 which I am paying thru maintenance. Need help as to understand that do i have to get the therman scanning done at my cost? and once the repair work is done as per the society's instructions, then do i have to re-do it?
