Order 21 rule 97

The decree holder file application under order 21 rule 97 before the executing court for the police protection as he is not able to get possession of the suit property by the bailiff due to unrest that.

Now the question is that... can the application be rejected . if it is rejected whether it can be appealed . if the executing court is the sr. division then where the order could be appealed.

The grounds of the rejection of the application . Please suggest ..

Partition suit.

Hello Experts,
A mother purchased a residential property in 1980 out of her husband's earning and still the mother is alive and the couple have 7 children, however the eldest son wants to file a partition suit as mother with the instigation of her other children is trying to alienate the property. My query is can a suit for partition be filed as the owner of the property is alive or any other suit which can be filed to stop the alienation of the suit property.
Plz need some suggestions.

Franchisee fees given to a pvt ltd company is deposit u/s

Franchisee fees given to a PVT LTD COMPANY registered with ROC-MCA can be treated as deposit to a company and under which companies act?
Fees paid as non-refundable franchisee fees for supply of GOODS AND SERVICES. AFTER PAYING OF FEES AND COMPANY FAILS TO SUPPLY GOOD AND SERVICES AS AGREED within 21-days and business not commence.
Can FRANCHISEE fees be treated as advance deposit paid to co. for supply of goods and services under which company act.
And at the last franchisee busniess doesn't commence even after 9-month also due to company fails to suply goods and servies as agrred upon.
If not refunded by company than what action can be taken under which law ot what other action can be taken under companies law

Loan related

Respected sir,
My father took a loan in the year 1997. This is unsecured loan taken by them at that time on his business. The loan became N.P.A.. in the year 2007. My father also died in the Year 2015. Now bank will send me notice to recover the loan. My father shut down his business in the year 2007 due to losses. Bank has right to take any legal action against me ?

Long term capital gain

Respected Sir/madam,

We had an ancestral COMMERCIAL property and from there we have received a profit of Rs 4 lakhs only. Can we further reinvest it by purchasing a commercial property again or can we buy a residential property or we need to invest it in NHAI or REC respectively or we need to pay tax on capital gain @20% of Rs 4 lakhs.

Please suggest. It would indeed be of great help.

How to change my lawyer without vakalat

Respected sir/ madam,

i am vishnu from madurai completed my degree , met with an accident at 2012, and lost right eye vision, so applied petition against the insurance company, till date i didn't atten single hearing, my lawyer also not communicating with such any of the details, so i checked e-court services it shows dismissed for default 4 times .claimed amount also 12 lakh rupees, so we really dissappointed with the lawyer, we asked him the case details back to us, but he refused even. please kindly help us. i cant go for any job really I'm stumbling. please mail me at vishnubmar@gmail.com.

SIR, AS MY FRIEND HAVE SUBMITTED CASE IN A COURT, BUT A ADVOCATE MENTIONED THAT IF THE HUSBAND WILL PROVIDE ORNAMENTS AND MONEY WHICH HE HAD TAKEN FROM HIS WIFE THAN WILL GO FOR RECONCILIATION AND MY FRIEND IS NOT READY FOR THE SAME BUT LAWYER TOLD THAT IS NECESSARY TO MENTIONED IN AFFIDAVIT IS IT TRUE ?

Deceased husband

Dear Expert
My husband left a house property. I have four grown up daughters. My dauhters want the property on my name. We have a certificate for legal heirs. we live in Tamilnadu and without much expenses, how to change the title on my name. We belong to muslim community.
