No, but it is an established principle and a condition precedent for any auction

If anybody wants to participate in any auction proceeding, they will personally observe the material used for auction, after satisfying the condition of the same only such respective persons willparticipate in such auction, if not satisfied anybody will not to do the same

Obviously, According to the law the auctioneer must perform his part of contract unless otherwise he can not impose. In case, during the advertisement it is vacant but on the day of auction, it is occupied. In this situation how can the auctioneer impose this condition on the buyer?
