Stamp duty on sale deed in surat, gujarat

(Querist) 29 June 2015 This query is : Resolved
I am Purchasing a property in Surat from a Bank under the SARFAESI Act in my wifes name.
I have been told that i will have to pay the Double Amount of Stamp Duty to get the Sale Certificate Registered.
The registrar considers one transfer of Borrower with Bank and the secont transfer with Bank and me.
I am also told that the registrar has the right not to levy chartges of 2 times Stamp duty.
Need clarification on the actual charges and weather the sub registrar has rights to charge less

Dear Sir,
I think it is not necessary to pay double stamp duty. Borrower (from Bank) can be seller and you (your Wife) will be purchaser. The Bank will join as confirming party. Please engage some Local lawyer for the purpose. Sale Certificate can also be drafted in this manner.
If necessary contact me with full details.

You need not pay the double stamp duty. Bank is not the seller. The bank is using its power and selling the property, as it was mortgaged to them.
