Sec. 12 of company law 2014

Hi All,

As per Sec. 12 of the New Company Act 2014 it is mandatory to mention the CIN no on company letterheads, invoices, notices and on all official correspondence and publications. apart from this i want to confirm whether it is mandatory to mention the CIN no the documents related to Gratuity and superannuation trust.

Please suggest me... thanks in advance..

under section 12(3) of the company's act 2013," Every company shall— ...........
(c) get its name, address of its registered office and the Corporate Identity
Number along with telephone number, fax number, if any, e-mail and website addresses,if any, printed in all its business letters, billheads, letter papers and in all its notices and other official publications......."
thus it is clear that the corporate identity number (cin) should be printed on all letter papers....and all official publications.
so, if the gratuity and superannuation trust is a company owned and managed trust, CIN should be mentioned on all related publications and documents.

It need to be mentioned if it is managed by company.

As Per the Newly notified section 12(3) of the Companies Act,2013, with effect
from 01.04.2014, every company shall paint or affix its name and address of its
registered office in legible letters , outside every office or place of business of the
Company.

Further, every company shall get under-mentioned particulars printed on all its
Business Letters, Bill heads , Letter Papers, Notices, official Publications etc , with
effect from 01.04.2014 :-

a) Name of the Company
b) Address of the Registered Office of the company
c) Corporate Identity Number (CIN) of the Company
d) Telephone Number of the Company
e) Fax Number of the Company
f) E-mail ID of the company
g) Website Address of the Company

Section 12 (8) of the Companies Act,2013 had provided for Penalty of Rs.1,000/-
Per day (for the period during which Default Continues), subject to Maximum of
Rs.1,00,000/-, on the Company and every officer, who is in default, for failure in
complying with provision of section 12 of the Companies Act,2013
