Removal of managing committee

(Querist) 27 November 2015 This query is : Resolved
Respected Sir,

As I am staying in a co-operative society which is registered in Jan,2013. From the date of registration no any activities done by the committee as per law. No any accounts get passed in AGM. Two AGM held in the last 2 years and both are adjourned and no any decision is taken till date. Share certificates is ready but not issued to members. No any election application made even the dead line of Dec,14 is over.

My question is, its possible to remove / disqualify managing committee, even nearly 60% to 70% members are ready for that. What procedure we need to adopt for the same or what action we need to take to remove such managing committee.

Request you to give your valuable suggestions.

1. Which state (Delhi, Punjab, MP, Maharashtra etc.)do you belong?

2. AGM proceeding ae incomplete without accounts for the year;

3. How a AGM is adjourned? Have you read law?

4. Disqualifications of member (not MC) and removal of MC is explained in each State Cooperative Act, Rules and Bye-Laws adopted by the Society, go through.

5. Consult a local prudent lawyer for further opinion, guidance and proceedings, however
prima facie it is a hypothetical query.

Go through the State cooperative Act.
