Property to sell

Dear Experts,

My mother being a GPA holder has transferred her self acquired property to her last son out of 3 children. Now in consultation with my mother , the son who got the property wants to sell and give the consideration amount to mother for disbursement as per her wish.

Now if he wants to sell, then is it necessary to obtain singature of other 3 children. Or is it necessary to be consulting witness of these 3 children in the selling transaction?

Please let me know the legal point in this matter. Regards.

Sir,

I believe he can transfer the property without obtaining anyone's signature. Because the property transferred by your mother is her self acquired property and he become the independent owner of the same.

Mother is only the GPA holder and not the absolute owner of the property. How she transferred the property by sale deed or gift or through some other method?

However, even if mother is GPA holder or the transfer is legal, signature of other brothers not required to sell the property.
