Project fees paid but project was not delivered on time and not completed properly, false promises

(Querist) 26 July 2016 This query is : Resolved
Hi,

I am Computer Engineering student and at the end of my final semester. We have projects to be delivered as a part of semester. These projects are sometimes tough and based on technical papers published on reputed websites like (IEEE.org) and for that usually almost all the student take help from some software/development firm.

I had also contacted one such firm who promised me lots of things like delivery on time, complete technical paper implementation, changes till project end, report preparation and documentation etc.

That firm initially didn't start my project on time and when I complained they started working at very last moment when my submissions were near.
I almost paid 80% of the fees and what I got in return is some false algorithms implemented in a very improper way. Copied code from online materials which is not even related to my project and Quality of the code is no where near good.

I really feel cheated and I have asked for the refund of my money because it had now cost me my semester and my project was delayed and I have to re-develop entire project. This has affected my career as well as I've lost a semester.

I am not sure where to go for to launch a complaint about this as I am not getting my project developed anymore and not getting my money back either.

Please help.

Thanks,

Mr. Sagar,

Did you allocate your project to the firm directly or through some freelance site?

You may share full facts and communications on record.

Project is given to firm by directly visiting its office. All payments paid were online and I have receipts as well.
Communication usually happened over the phone but in some cases, we have kept emails.

Whether any agreement was entered?

If you proceed with legal steps, it would be proof that you tried to cheat your institution / entrusted your project to some other to complete for you / took assistance of third party without due permission, which you can not deny. Would your institution / university allows such position after documentary evidences?

Discuss in detail with local lawyer after showing him institution rules.

If you have the evidence you have the merits.

You may also revert on observations made by Expert Mr. Rajendra K Goyal.

Thank you all experts.

I agree with Expert Mr. Rajendra Goyal's point and I am definitely paying for my wrongs already. But it looks like the firm will continue to cheat others as students like me cannot come forward risking entire degree.

I'll have to live with my losses then and bury this matter forever.

What for students have union!

As far as loss suffered your able counsel may opine to file for damages.

In future stay away from shortcuts and unfair means.

Mr. Sagar.

If you don't mind, both of you have violated different laws. Although violation of contract law and incident of cheating is there on the part of the project writer, but on your part also you were also not permitted to hire services of any freelancer for accomplishment of your educational project for submission to the university in partial fulfillment of the degree, you were working for. So, you also tried to cheat the unversity by using plagiarism.

So, if you take up a case against the freelancer, pandora bax can also be opened by that fellow against you, unless you have some agreement entered by you with that fellow. Without proper project description added with entring in to any specific agreement, you can't expect quality job from a freelancer. In educational projects, only a few freelancers can be expected to ensure delivery of quality jobs.

So, must weigh pros & cons of your proposal before you try to proceed legally.
