Plot sold without converting to layout

Respected Experts...
In Maharashtra , at municipal council area, a non agricultural land was Sold by a land developer by fragmentation into Plots...The said plots were neither converted to Layout nor any prior permission of any Development authority or sanction was taken as laid down by legislature as per Land laws of Maharashtra....Said plots were just handed over to the Buyers on just a non registered 100 rupees stamp paper....

Is this permissible??? What type of actions could have been taken against that Land developer??? Who is competent authority to take lagal actions as per the Land laws of Maharashtra in a municipal council area???

How are you concerned with the query?

Buyer can lodge complaint / FIR with the police.

Complaint can also be lodged with the administration and the urban development department.

The town is administered by municipal council....The land in question is of a farmer...I m not at all directly concerned with the problem...Some agrieved villagers approached me then i searched online and also search Maharashtra Regional and Town Town Planning act 1966 and Maharashtra Land revenue code 1966 ....But.i found nothing related to the question that what could have been done if anyone Sold plots without prior permission from Government officials and without sanction from development authority

The buyers shall take precautions before purchase of immovable property such as link documents, EC on the property from SR concerned and with consultation of local lawyer or registration officials. Now all the purchasers file a case in a court of law and also make complaint against the seller/builder to the Mpl.Counsil/Mpl.Authorities, District Collector, Development Authority.

One should always prefer to get proper legal opinion from a very able local counsel of unshakable repute and integrity specializing in revenue/property matters before signing/buying/making payment.




It may cost some FEE but can protect long term interest and hard earned monies.

In most of the states it is criminal offense to sell plots without due approval of the development authority.

In spite of this fact, it is hard fact also that such plots are being sold taking advantage of loopholes / illegal colonies are existing and are being formed. After some time some political party regularize the colony and nothing remain illegal / unauthorized.

Selling the non residential land as residential plot is violation of T & P rules.

Selling the land without registration means it is not a fair deal, the land might be owned by government.

If it is so, lodge a complaint to Collector and give copies to Municipal authorities, Police, etc.

while the entity is not lawyer but a Liar
