You can try for bail from the trial court itself.

Anticipatory bail can be obtained only by sessions court & HC. Isn't it ? My case is pending before CMM. So wouldn't anticipatory be filed before Sessions/Hc ?

Whether the matter has come before magistrate court for trial?
I think the IO has not filed charge sheet hence the court has not sent summons or notice to the accused?
Whether the police has not attempted to remand your accused?
Anyway filing anticipatory bail isa different subject to that of the quash petition.
Discharge can be filed in the trial court after the police has filed the charge sheet but before the initial questioning by the court to the accused on the basis of charge sheet.
