Person wants share in the property of father

Dear Sir
My father made an agreement the person to sell the house in 2006 the decision is pending in the court. because father said this is made in the drunkard manner and the second party said that my father has sold full house of 1240 sq feet but thisis the total area of the house which was bought by my grandfather and he had two son my father and my uncle. how can anyone claim on the full house when there are two partners. and can i also claim on the same property to save the house. please advised me.

1. You can join as a necessary party in the ongoing civil suit and then claim your share. If this was ancestral house then the Uncle too was required to give his consent.

In absence of any will of your grandfather, your uncle may file suit for partition.

In your grandfather's self acquired property, you do not have any right to a share whereas your paternal uncle can obtain a stay and also seek partition and separate possession of his share in the property.
