Payment of gratuity

DEAR SIR
i was working in a private school. I have completed 4 years 7months and 15days. I have not been paid my 16days of EL encashment. They have taken it as part of notice period. Am I edigible for getting the gratuityt?

Schools are covered under the Payment of Gratuity Act 1972. Four years and seven months if correct eligible for gratuity. You can send form No I to the Management and proceed to file a case with the controlling Authority of the area.

Dear Sir,
Normally 5 years completed years will be required to eligible to get gratuity. If your issue based upon any “parity” ground then approach high court.
