Mental harassement

Guest (Querist) 21 January 2018 This query is : Resolved
i was working for an organisation where faces mental harassment from my seniors and colleges. i even filed a police complaint but later i took my complaint back when the matter reached to my senior manager and did not filed the FIR. but even after the complaint, harassment continued and i left the organisation and joined the different place. Since this is a small world and at my current job, they knew the matter at my previous organisation and it affecting my job here too. One day, due to mental stress and i was under the influence of alcohol. i called up my previous organisation's recorded official line and used all the bad language including the religious remark to my ex-colleges.
I want to now what kind of legal action they could take because my such action.

You have landed your self in Soup.Tender an sincere apology in person before they could think of proceeding to punish you.You should not make any comment on any one's religious beliefs. You should shut your mobiles and restrict your words/conversation while under the influence of alcohol.Only an regret and apology could protect you from troubles. If things were beyond your limits better discuss it with local good Advocate

IPC sections 500 and 153 A,295 and 295 A would precisely suit you for your actions.

Harvinder, as your name suggest most probably you're a Sikh by religion, now whether you're male or female I can't guess but the mental harassment you faced during your previous job tenure for which matter was reported even to Police, gives the inclination that you're a female who had guts to report the matter to police but after intervention of senior manager you didn't get FIR registered. Had the FIR registered against the person(s) indulging in sexual harassment serious action would have taken against him/them. Hope you still have copy of the Police complaint you made at that time and other related documents with you. These will be of help to show the continuous provocation done by others for you to indulge in wrong against them even after your leaving the company.
Now after leaving the company and joining a new organisation you still feel unsafe and because of the insecurity you took wrong step by calling the official lines of the previous office for abusing the person(s) who had been inflicting harassment on you. The first important thing that has to bee checked if the conversation you had with the person on other line was recorded or not. If there was no recording of the conversation the chances any criminal complaint will be registered against you may not be possible. The Court will like to see rather hear the conversation as evidence to charge or prosecute you for charges of promoting enmity on the ground of religion, outrage religious feelings etc. U/s 153A, 295A IPC or defaming the person(s) U/s 500 IPC.
You indulged in this wrong while under the influence of alcohol can be used in your defence if there is any interrogation done by the police but the proof of being in that state of mind too has to be proved by you in your defence, hope you are more than 25 years of age and are legally eligible to consume alcohol.

Very strange question, "I want to now what kind of legal action they could take because my such action," when no problem for the time being!

By the way, if someone tells you what they could do, what you will do to avoid that?

When you showed the courage under the influence of alcohol. you called up your previous organisation's recorded official line and used all the bad language including the religious remark to your ex-colleagues, now show some patience in wait of their reaction.

They would not be so idiots to take any legal action against you. Some of them of course may try to take revenge from you through background verification by sending adverse report along with your recorded calls, whenever you change the organizations.

For the time being forget about the incident.
