Legal status of artificial insemination

There seems to be no clear law w.r.t to Artificial Insemination(AID, AIHD). Has the Supreme Court given any judgement with regards to this?

Bill is pending and is in final stage of draft by Health and Family Ministry.

Draft bill was circulated on 30 Sep 2015

Basically, i wanted to know the legitimacy of child born through artificial insemination and his property share in a hindu joint family. ( Artificial Insemination with consent of husband).

How are you concerned with this matter?




The doctor that conducted the procedure would have taken care to ensure that the donor and the recipient sign a contract:: whereby the donor provided sperm to the recipient with the expectation that she would become pregnant through artificial insemination.





A child born as a result of artificial insemination is considered as legitimate, provided the child was born during lawful wedlock.


Artificial insemination does not contravene ethical principles of medical practice
