My grandfather died in the month of july 2016. He has not made any nominees in his bank account. We need to make a legal hier certificate for the banking purpose to withdraw the money from his account.

The local Tehsildar's office may be issuing it, after inquiry(ies) by revenue officials say: Kanaungo, Patwaari.

At some locations any Legal heir may appear before designated Authority in say; People Convenience Centres; say Suvidha Kendra and submit an affidavit before Ex. Magistrate and get it same day.

The local BM/banker may:
-accept verification by local Area MC Councillor.
-pay as per threshold value set by bank.
-ask all legal heirs to sign Disclaimer in favor of one legal heir and accept Indemnity,surity and pay.

In any case legal Heir Certificate, once obtained can be useful for future purposes also.

There are far difference between legal heirs certificate and succession certificate. For movable property(i.e. bank balance, share and security investment) no need to obtain Legal heirs Certificate. For small amount of money bank generally pay to the successors by making indemnity bond, affidavit of successor and no objection by non-claimant, contact with bank. Failing which you should obtain Succession Certificate from the court by filling a case, that bank must pay to the successors.

Bank may receive sworn affidavit from person known to Bank, good for amount involved declaring the legal heirs of the deceased, if you are facing difficulty in getting legal heir certificate.
The procedure is in line with the RBI directives.

The certificate issued by Tahasildar is legal heir certificate it is not succession certificate, succession certificate can be issued only by civil court.
