Land encroachment

Sir, I am 24 yrs female now, I got no parents and brought up by my relatives and when I was 02 yrs old, part of my land has been encroached by my neighbour, which he has constructed his house, he encroached 2 square feets almost a length of 100 square feets. How can I deal with this issue????

Collect all the documents To Justify your Claim and Consult a Local Good Senior Civil Side Advocate and First Serve a Notice for Encroachment and Proceed Legally in Court.

What documents are you having in favor of your claim?

Have you asked to your neighbor to return the land, what is his replies?

What is the total area encroached? Whether only 2 Sq. feet land is encroached or 2 feet at 100 ft length i.e. 200 sq. ft. land is encroached?

Show all documents to local lawyer if no amicable settlement possible.

When you aware the encroachment and did you raise the issue with your encroached neighbor? what his reply. where are you from

Try to have amicable settlement e.g; let him pay for it and you agree to register in his favor.

Or he agrees to demolish and vacate.


If nothing works, approach a very able counsel and get relief thru court of law.

Personally from land record dept. you have to verify survrey sheet , and Measurement extract of both Plot.

Rather proper measurement of both plot required to be checked.

After that you surveyor conclude that land is encroached , then legal steps should be taken .

Now first question is when he encroched 100 Sq. feet and constructed house ?

Whether he took permission of local authorities for construction ?

Whether he is paying and house tax to local authorities ?

So many question will arise and then best possible solution should be worked out.

There can not be fixed ans. to question it depends upon individual case how to solve this problem , because making some deed won't transfer the land legally .

Land is required to be divided legally in land records , two sub -survey no. is required to be made and then one sub survey can be transferred if he is willing to compromise.

Additionally only 100sq. feet of land can not be divided into another survey no.
