Hindu succession act

Sir
One of my client is unmarried daughter of her father. She is having ancester property of her grandfather. Her father sold out the property without given her share from this property.
Can she is entitle to get the share from her ancestor property as per the Hindu succession act??

Dear Mitul,
Just because the property came from her grand father does not automatically mean that the property is 'ancestral' in character.

First you have to indicate who originally purchased the property and in which year.

Thereafter you have to indicate in which year the original purchaser died.

So before determining the real character of the property, dates and events are a must. Without this information nobody can ever say whether the property is 'ancestral' or not.

In this Modern world the Buyers are Not Illiterates to Buy any Property with out having a Legal Opinion of the Documents which they propose to buy.Even if the Seller the Father is desperate to Sell the Buyer would be more cautious being the Investor.Unless and until they are Legally satisfied the Transaction would not have taken Place.

Any Buyer who Proposes to Buy a Property would have Certainly done a Legal Opinion for the documents .In this modern world every one is knowledgeable and Even if the Seller the Father is desperate to Sell the Buyer who in Investing the Money would have taken care of it by Confirming the Legal Validity.Unless and Until the Seller was the Absolute Owner the Transaction would not have taken Place.

I Agree with the opinion of our experts.

In addition, the said father got the property through any WILL OR SETTLEMENT from the grandfather mean its can't be treated as ancestral property of the daughter. It is father's self property.
