I M WORKING WITH PVT. LTD. CO. SINCE LAST 3 YEARS. THE GRADUIETY IS PART OF MY CTC. NOW CO IS FORCING ME TO GIVE RESIGN AND REFUSED TO PAY GRADUETY AMT GIVING REASON THAT YOU HAD NOT COMPLETED 5 YEARS. HOWEVER IT IS PART OF CTC OFFERED. KINDLY ADVICE

1. Record the threats/Force/Pressure/coercion/Intimidation to Resign (audio/visual/minutes/witnessed etc).


2. Once you have irrefutable evidence you shall have better chances for everything at appropriate time in appropriate forum.


3. There are threads by employee's that have succeeded to get Gratuity:::::when Gratuity was included in CTC......at:

Employer can provide better/superior terms/policy for payment of Gratuity.

First you have to decide whether you want to resign or not.

If you opt to resign, naturally, you have not completed 5 years of service and therefore not eligible for payment of Gratuity. The employer is right when he says so.

Premature academic question, if you are still in service of the company!

Also, is it not strange that even a person of the rank of an Accounts Manager does not know the real term of entitlement, as mis-spelt as "graduety" both in the title as well as the text of the query?

So, clearly, it is a query from a student, posing himself as an accounts manager.
