Ex-parte in 125 cr.pc

Ex- Parte is ordered against respondent under 125 Cr.P.C but still he dose't applied for set aside so many dates are passed ,the main thing is Execution and 125 are listed on the same day in execution he is appearing with his counsel, than if he now apply for set aside how could he say that he was not aware about ex-parte .What should i do if he move such application and court grant it.

Please write the complete facts. If they both are listed on the same day, max. he could take one date on this excuse.

My two cases i.e execution and 125 Cr.P.C are listing on the same day in the same court in tis hazair family court 125 is ex-parte against respondent , however in execution opp. party is appearing , they have not yet moved application for ex-party set aside, if they move in future can i oppose or go in appeal on the ground that they were aware about the facts and intentionally delaying the matter of 125.
