Dear Sir,

my friends' sister got marriage nearly 13 years back.she lived at husband home nearly 2 years only.some personnel difference they are living separately from past 11years.She is living with father & Mother.Now she is asking me to, do help regarding her future life.ie she is willing to file a suit for maintenance. many time both the family parents are made compromise meetings to resolve their difference,but not succeed.can she file a suit for maintenance? kindly advice.

For maintenance there are many choices:

1.Court fees less proceeding under section 125 of Cr.P.C;
2.Court fees less proceeding under Domestic
Violence Act;
3.On terms of paying court fees or suing as indigent under Hindu Adoption And Maintenance Act.

OPtion 1&2 are speedy but no arrears of past claim can be recovered.Option 3 allows recovery of past 3 years.If arrears or not sought,option of 1 or 2 or even both can be utilized.
