Cheque and cash robbed

Dear Sir,

While I was travelling to my relatives I become the victim of robbery i.e someone snatches my briefcase in which I carries my cheques and cash along with me as there is no one present in my home presently and there is frequent cases of theft in a closed house so I took cheques and cash of around 100000 along with me, but unfortunately someone snatches my briefcase containing cheques and cash. Now my question is that after lodging a fir about the snatching what should I do to stop the illegal use of my cheques. There are around 25 unused cheque leaves of which only 2-3 are signed and remaining are unsigned. Is there is any provision that the bank put the remarks as stolen cheques instead of stop payment or insufficient fund when presented for encash. I have doubt that someone has intentionally done this to hamper me financially but didn't able to prove. Plz advise what next should I do inorder to stop the illegal use of my cheques.

NO FOOL WILL PRESENT STOLEN CHEQUES!!

HOWEVER,
You inform Bank to "STOP PAYMENT" and immediately report to police as well as you, if any stolen cheque come for encashment/ clearing.

immediately remove bank balance, keeping only minimum bal.

Dear Sir,

If any chq come for clearing/encashment, it is the duty of bank to inform me/police about the stolen chq. What if bank bounce the chq which come for clearing inspite of being informed about the chq being stolen. As I have doubt someone has intentionally done this to me, if he tries to harras me by bouncing the chq what should I do if someone done this, and sie what remarks should bank put if these stolen chqs come forward for clearing. Plz advise.

Dear Sir,

Snatching/stolen came under same category.or snatching came under lost of chqs.as lost of chq nowadays covered under NI Act.

Bank would note stop payment instructions on your request.

Due to CBS system, it may not be possible for the Bank to inform you regarding presentation of the cheque.

Dear Sir,

So plz suggest me the way by which I will be safe from any financial damage as well as legal action that can be arises due to cheque bounce, is this be possible that I can apply for new cheque book saying bank that the previous all unsed chqs were stolen along with the fir copy, is this be possible for the bank to make all the stolen chqs as invalid on my request, or plz suggest me the way by which I will be safe...

You have adequately been advised.

Inform bank and police.

If as per bank's provisions in internal systems a comment ' reported as stolen/snatched' as per your report can be mentioned then bank staff will do it.



Otherwise also you may write a detailed letter to bank and obtain acknowledgment on your copy......................and if the bank is closed send email or call 24 hour toll free number and record the call.

Why are you mixing two aspects i) stolen cheques ii) apprehension that the cheque would be returned for financial reasons. Are you sure that you have divulged all the facts? There is no need to put this query in this portal. Instead you have gone to the Bank's branch and give report that the cheques are stolen and they are not to be honoured. At the same time you could even apply for new cheque book. Cooked and tailor-made queries will not help you. Your problem is so simple that you given a letter to the Bank that the cheque book was stolen and cheques if presented should not be paid and apply for new cheque book. For this simple solution, you could weave as many queries as possible.

If disease is properly diagnosed it is half cure and easy for further elimination.

When you give wrong details further trouble is sure and certain.

1) Your story has no substance since why you carry signed cheques.

2) When as you say bag is snatched there must be many people around and so should have been instant police complaint.

Stolen cheque, blank cheque and even misused theories are rejected by courts.

There are many technical issues in any cheque bounce case which can be used to come out of any cheque bounce case and not such theories.

Rightly adviced by all the legal experts and Mr.Jagga Rao has clearly put forward the querist's intentions.Nothing but academic query.

If the story is real after lodging the police complaint,U would have immediately rushed to the concerned bank and give a complaint.

Sir,
Actually I have asked my query hy beating the bush around, mu actual case is different, we have a shop in jhansi, and employed a manager there and my father and me being the partner, I reside in nagaland with my family and my father stay here, my father is a senior citizen of75 yr and our manager take him in full confidence, so he used to give him signed blank chqs of mine for doing rtgs to company, and never pay attention to him due to his illness as he is aged person and never tell us about anything, but now few months back he ran away and take the money of sold good along with him and also now we came to know that there are around 38 chqs are unused in bank and we dont know about it where are they, and also he forged my sign in chqs and used in bank for transaction and bank passed all the chqs, and also issued chq books from bank by forging my sign,
Now my query is this,
1. In what way we block these unused chqs from misuse,
2. Is the stolen story will do the job, which i have asked earlier,
3. Is there any full proof way to prevent these chqs from dishonoured as our manager has gave some chqs to buainessman and took money from them in our name,
4. As police is not doing any satifactory job in our fir, not even to put chargesheet against him,
5. We only want to be save from NI Act, as the missing chqs is the major issue,
6. Court will not hear our story as there is 100%our mistake that y we gave him chqs.
7. We are doing fir in m.p that somebody took our bag in which we kept our chqs, cash and imp.docs along with us as there is no body in the house so we took it with us.
Please advise sir what to do as there is no good lawyer in my area
