(Querist) 27 May 2015 This query is : Resolved
After 35days of registering the sale deed by the sub-register, whether he can cencell the sale deed without the checking the original documents or without checking the latest Encumbrance certificate.

Whether the sub-register has the power to cancel the register documents even it is mortagaged to some one?

Mr. Sunny,

Discuss your real problem with background of the case, if your really have any. There is no use of asking an academic query.

Dear Sir,

Mr.A sold the land to Mr.B by registered documents. Then Mr.B mortagaged the land to me keeping the original documents with me. then after both the Mr.A and Mr.B approached sub- registrar for cancellation of sale deed between Mr.A and Mr.B
The sub-registrar without checking mortagage status and the original registered documents or without consulting me, sub-registrar cancelled the sale deed
What i have to do?

Did you register the mortgage deed?

Further, do you want to say, the registrar cancelled the sale deed without producting the original registered sale deed lying with you?

Still further, have you approached the registrar on this issue and in what manner and what is his response?

Sir,

yes the mortgaged deed was registered and i paid the challan amount also.
Yes registrar cancelled sale deed without verifying the original documents lying with me.
When i approached the registrar he replied in rude manner and said he has the right to cancel the sale deed.

Can you send me copies of registered mortgage deed, registered sales deed and other related documents, if originals are in your possession for my examination and analysis through email at: dcgroup1962@gmail.com ?

The points that you have posted in the posts certainly raise the need to examine all documents by an expert.
